nFADP (Swiss Data Protection Act)
Switzerland's revised Federal Act on Data Protection, in force since 1 September 2023.
The revised Federal Act on Data Protection (nFADP, in German revDSG) governs how personal data is processed in Switzerland. It brought Swiss law closer to the GDPR, with stronger transparency requirements, privacy by design and by default, and a duty to report certain data breaches. It is supervised by the Federal Data Protection and Information Commissioner (FDPIC).
Points that matter for verification
- Biometric data that uniquely identifies a person is sensitive personal data.
- People must be informed about the processing, including recipients and countries abroad.
- A data protection impact assessment may be needed for high-risk processing.
- Fines under the nFADP are imposed on the responsible individuals, not the company, and can reach CHF 250,000.
